Marijuana: Zogby Poll Shows Majority Support for Taxing and Regulating Marijuana on the West Coast, Support Climbing Nationwide

Support for taxing and regulating marijuana has climbed above 50% on the West Coast, according to a national poll of 1,053 registered voters. The poll was conducted by Zogby International and was commissioned by California NORML and Oakland's Oaksterdam University.

The poll found that 58% of West Coast respondents agreed that marijuana should be "taxed and regulated like alcohol and cigarettes." Only 36% of West Coast respondents disagreed.

On the East Coast, 48% supported legalizing marijuana. In the south and central US, support fell to 37%. Overall, 44% of respondents nationwide agreed that pot should be taxed and regulated.

That's roughly in line with a CBS/New York Times poll earlier this month that found 41% of Americans favored legalizing marijuana, up from just 27% in 1979. That, said national NORML executive director Allen St. Pierre, is a good thing.

"Public support for replacing the illicit marijuana market with a legally regulated, controlled market similar to alcohol, complete with age restrictions and quality controls, continues to grow, and appears to have achieved majority support on the West Coast -- where many voters are already familiar with the state-licensed use and, in some cases, sale of medical cannabis," he said.

"As voters and legislators continue to look for alternative ways to raise tax revenue for public services and reduce law enforcement costs in this troubled economy, we expect the public's support for taxing and regulating cannabis to continue to grow -- not just on the West Coast, but nationwide."

Feature: DEA Raids More California Medical Marijuana Dispensaries, Prompting Obama Administration to Reiterate Pledge to Stop Them

DEA agents raided four medical marijuana dispensaries in the Los Angeles area Tuesday, hitting two in Venice, one in Marina Del Rey, and one in Playa del Rey. The raids come nearly two weeks after President Obama took office and on the same day that Eric Holder was confirmed as head of the Justice Department, the agency that oversees DEA operations. They mark the second such incident taking place under the Obama administration, the first being a January 22nd raid of a medical marijuana dispensary in South Lake Tahoe.

President Obama made repeated campaign pledges to halt the raids on dispensaries operating within California's medical marijuana laws, and by Wednesday night, White House spokesman Nick Shapiro was telling the Washington Times that the raids would end once new DOJ officials are appointed.

"The president believes that federal resources should not be used to circumvent state laws, and as he continues to appoint senior leadership to fill out the ranks of the federal government, he expects them to review their policies with that in mind," Shapiro said.

The raids came a day before the National Organization for the Reform of Marijuana Laws (NORML) announced it had commissioned a poll by Zogby International that found overwhelming support for ending the DEA raids. The poll asked the question: "During the presidential campaign, Barack Obama said he would stop federal raids against medical marijuana providers in the 13 states where medical marijuana has become legal. Should President Obama keep his word to end such raids?"

More than two-to-one in all geographic, demographic, and political groups answered "yes." Overall, 72% of respondents said stop the raids.

No one was arrested in Tuesday's raids, but as is typically the case, DEA agents broke down doors and seized marijuana destined for patients as well as cash and computers. Several dispensary operators told California activist organizations that agents acted even more aggressively than usual.

"Those raids were little more than piracy," said Dale Gieringer, head of California NORML. "The conduct of the agents was unprofessional and vindictive. They call them 'investigations,' but they just go in there and steal medicine and money and smash things."

Gieringer cited reports he had received that DEA agents destroyed surveillance cameras at at least one location, possibly destroyed a computer hard drive at another, and took bags of cash without counting it or providing a receipt from another.

"Whose interest does that serve?" asked Gieringer. "And not counting the cash, that's a real no-no. This whole thing needs to be investigated; it's not serving any legitimate purpose. And they picked on places that were modest, well-controlled, legal under state law, and no trouble to anybody. That's pretty scummy."

Drug War Chronicle contacted all four dispensaries hit by the DEA Tuesday, but in each case, either no one was available or no one was willing to talk about the raids. Nor did Los Angeles DEA spokesperson Sarah Pullen, who usually talks to the Chronicle, respond to repeated requests for comment.

Pullen did talk to the Los Angeles Times, but she didn't have much to say. "I can't get into details as to the probable cause behind the warrants except for the fact that they're dealing with marijuana, which is illegal under federal law," she said.

But Kris Hermes, a spokesman for Americans for Safe Access (ASA), said allegations of DEA misconduct during raids are nothing new. "We have received repeated reports of DEA agents not counting cash or providing receipts, as well as instances of agents damaging surveillance cameras placed in facilities to record what is going on inside and outside," he said. "A few months ago in Long Beach, while the federal agents were smashing video cameras, other cameras were recording them doing so and sending the images to an off-site server, so, in this case, at least, we have video evidence of them doing just what they are again accused of."

Hermes also noted that even without the extracurricular activities, the DEA raids on dispensaries are heavy-handed and thuggish. "If you look at them smashing doors and windows and leveling any property in a facilty, that's pretty routine, and has been happening for the past couple of years," he said. "They go in with paramilitary gear, with flak jackets, automatic weapons, sometimes even wearing ski masks, destroy what's inside, and take medicine, money, computers, and patient records, and trash the place."

"This is upsetting," said Bruce Mirken, San Francisco-based communications director for the Marijuana Policy Project. "It's impossible to know at this point how high up this was authorized or whether it was Bush holdovers still doing what they've been doing, but candidate Obama made a promise on this, and it's time for him to keep it," he declared Wednesday, prior to the White House response appearing in the media.

"That should mean it's time for a major housecleaning at DEA, and that's the right thing to do, not only morally, but also politically," Mirken said. "California voted for Obama, as did 11 of the 13 medical marijuana states, including traditionally Republican states like Colorado, Nevada, and New Mexico that flipped into the Obama column in the November elections. And medical marijuana outpolled Obama in Michigan. There is no downside for Obama in doing the right thing."

Mirken was singing a significantly happier tune by Thursday morning. "The White House comments last night are very significant," he said. "This is a historic break with 13 years of federal policy since Proposition 215 passed in 1996. The simple decision that federal resources should not be used to undermine state medical marijuana laws is a fundamental change from the policies pursued not only by Bush, but also by Clinton," he said.

"A lot will depend, of course, on the follow-through," Mirken continued, "but this is a clear signal to the folks at DEA that the game has changed. Now, we will have to see what happens next, both with ensuring that the raids actually stop, and more broadly, that the Obama administration adopts the general theme about respecting science and basing policy on facts rather than ideology. This, I think, marks the beginning of the end of a tragic and stupid federal policy, and all I can say is thank god."

During the long-lived presidential campaign, then-Senator Obama stated in August 2007 that he "would not have the Justice Department prosecuting and raiding medical marijuana users... It's not a good use of our resources." In March 2008, he reiterated that: "I'm not going to be using Justice Department resources to try to circumvent state laws on this issue."

Two months after that, an Obama spokesperson told the San Francisco Chronicle: "Voters and legislators in the states -- from California to Nevada to Maine -- have decided to provide their residents suffering from chronic diseases and serious illnesses like AIDS and cancer with medical marijuana to relieve their pain and suffering. Obama supports the rights of states and local governments to make this choice."

Not surprisingly, ASA, the country's largest medical marijuana advocacy group, jumped in with calls for President Obama and Attorney General Holder to turn promises into policy. "As the new Attorney General, one of Eric Holder's top priorities should be to end these harmful raids on state-sanctioned medical marijuana providers," said ASA director of government affairs Caren Woodson. "And, until a new head of the DEA is confirmed, Holder has a responsibility to cease the existing policy being carried out by Bush Administration officials. Attorney General Holder has the ability to halt this harmful and outdated policy," said Woodson. "And he should do so immediately."

Other drug policy groups joined the chorus as well. "When President Bush was on the campaign trail in 2000 he promised not to interfere in state medical marijuana laws, but that turned out to be a lie as the DEA proceeded to terrorize medical marijuana patients and providers by raiding dozens of dispensaries across California," said Stephen Gutwillig, California director of the Drug Policy Alliance (DPA). "President Obama said on the campaign trail that these raids would end under his administration and millions believed him. We hope these recent raids don't represent official administration policy and that Obama will order federal agencies in no uncertain terms to stop harassing medical marijuana patients and providers in California."

"President Obama needs to show federal agencies who is boss," said DPA national affairs director Bill Piper. "If he doesn't put a halt to these raids, the DEA will continue to undermine his campaign promises."

By Thursday morning, ASA was tentatively congratulating the White House for its reiteration of those campaign pledges. "More than 72 million people live in a state that has enacted laws that authorize the limited use and distribution of cannabis for therapeutic use," Woodson said. "The White House's comments have provided patients and their loved ones a sense of relief, and we hope the President and our Attorney General will keep this pledge in mind when considering appointments to the DEA and Office of National Drug Control Policy."

Perhaps, finally, a new day is dawning when it comes to the federal government's stance on medical marijuana. But the weeks and month to come are what will tell.

Support for Marijuana Legalization is Growing in America

A new CBS/NYT poll finds that 41% of Americans agree that marijuana use should be legalized. While legalization still fails to garner majority support, it’s clear that we’re headed in the right direction. Notice that only 27% supported legalization in 1979:

There is a huge generation gap on this issue. More adults under 45 (49%) approve of legalizing marijuana use than oppose (45%), while just 31% of adults over age 45 approve of it; six in 10 are opposed.  


The generation gap is particularly encouraging, confirming a popular theory among reformers that if we simply wait not-so-patiently, we’ll eventually win when our opposition literally drops dead.

These numbers reveal that we’re well within striking distance of achieving majority support for legalization. Moreover, we’re comfortably within the range in which meaningful reform to our marijuana laws will produce significant and vocal approval from the public. If there was ever a time when our political climate was fatally non-receptive to this idea, we have moved beyond that.

Keep in mind that the 41% result was arrived at without any particular political context. That’s just the number of people who generally walk around believing that marijuana should be legal. It’s possible to build that number significantly when the question is framed around an actual policy proposal, such as in Massachusetts where 65% of voters supported decriminalization. Because our arguments are strong, we benefit from the debate.

Legalization initiatives were unsuccessful in Nevada and Colorado in 2004, but I’d like to think that in the current change-focused political climate, it’s quite possible that similar measures would be victorious. For one thing, the departure of drug czar John Walters means we’re unlikely to face the same vicious opposition we’ve become accustomed to, as I simply do not envision Obama’s White House undertaking a regional propaganda scare-tour the next time we try something big.

The fact is that we’re moving in exactly the right direction, though not nearly as fast as any of us would prefer. We must be patient, so long as our patience doesn’t take the form of inaction. We’re entering a period of remarkable political opportunity for our cause.

Fixing Our Criminal Justice System Isn’t Political Suicide. Stop Saying That.

Washington Post has a whole story on Virginia Senator Jim Webb’s thoroughly awesome ideas about criminal justice reform:

This spring, Webb (D-Va.) plans to introduce legislation on a long-standing passion of his: reforming the U.S. prison system. Jails teem with young black men who later struggle to rejoin society, he says. Drug addicts and the mentally ill take up cells that would be better used for violent criminals. And politicians have failed to address this costly problem for fear of being labeled "soft on crime."

Webb aims much of his criticism at enforcement efforts that he says too often target low-level drug offenders and parole violators, rather than those who perpetrate violence, such as gang members. He also blames policies that strip felons of citizenship rights and can hinder their chances of finding a job after release. He says he believes society can be made safer while making the system more humane and cost-effective.

Sadly, one rarely hears a Washington lawmaker talk about our drug policy priorities in a way that makes any sense. So, fittingly, Washington Post dedicates plenty of space to the theory that Jim Webb’s gonna get massacred for his crazy blasphemous ideas:

"It is a gamble for Webb, a fiery and cerebral Democrat from a staunchly law-and-order state."

"…as the country struggles with two wars overseas and an ailing economy, overflowing prisons are the last thing on many lawmakers' minds."

"…Webb has never been one to rely on polls or political indicators to guide his way."

"Some say Webb's go-it-alone approach could come back to haunt him."

No, it won’t. Just watch as that completely fails to happen. Recent polls show that democrats and republicans agree the drug war has failed and that is just a fact. Too bad it’s fact that completely eluded The Post throughout a lengthy article about the politics of criminal justice reform. They found room to postulate endlessly about the supposedly disastrous political consequences of saying anything bad about our policies, but they couldn’t find a single line to show what the public actually believes.

Of course, to include actual relevant polling data would refute a central point of the article: that there’s something really mavericky and even reckless about Webb’s ideas. There isn’t. Those same ideas didn’t stop Obama from winning Virginia, so this whole political-suicide-by-drug-policy-reform narrative is garbage. Stop trying to recycle it. Just put it where it belongs.

Marijuana: Narrow Majority of Arkansans Favor Decriminalization, Poll Finds

A recent Zogby International poll commissioned by the Arkansas-based Drug Policy Education Group has found that a slight majority of respondents favor decriminalization of the adult use and possession of marijuana. The poll was conducted November 7-11 and was based on a Zogby online panel of 436 voters deemed by Zogby to be representative of the state's adult population. The margin of error was +/- 4.8%.

Respondents were asked the following question: "In 2007, over 7,400 adults were arrested in Arkansas for misdemeanor possession of one ounce or less of marijuana, over half the state's total drug arrests. According to a national 2005 study, state and local governments spend an average of $10,400 per arrest on police, courts, and jails. Based on that estimate, 2007 marijuana arrests will cost Arkansas taxpayers nearly $77 million dollars. Knowing this information, would you strongly support, somewhat support, somewhat oppose, or strongly oppose a law that would eliminate the penalties for adult marijuana possession of one ounce or less?"

Slightly more than 35% strongly supported changing the pot laws, with another 17% somewhat supporting it, for a total of 53% in favor of decriminalization. On the other side of the coin, 38% strongly opposed and 7% somewhat opposed decrim, for a total of 45%. Three percent weren't sure.

Democrats and independents supported decrim by a margin of two-to-one, but only 29% of Republicans supported it. Intensity is on the side of Republicans, with 63% strongly opposed compared to 49% of both Democrats and Independents who are strongly in support.

A slim majority of voters under 64 would support decrim, with the highest proportion among the under-30 group. Among the young, 58% supported decrim. Majorities of both whites (51%) and African Americans (64%) said they would support such a law, while women (59%) were more likely than men (46%) to say they would support it.

A similar, but slightly differently worded poll commissioned by the Drug Policy Education Group in 2006 had similar findings. In that poll, which asked voters if they would support "reducing" the penalties for adult marijuana possession offenses, 61% said yes, while 35% said no.

Arkansas has been the scene of drug reform activism, mainly around marijuana, for several years now. Initiatives making adult marijuana possession offenses the lowest law enforcement priority passed by two-to-one margins in Eureka Springs in 2006 and in the college town of Fayetteville this month. State drug reform groups like the Drug Policy Education Group and its predecessors have also been tilling the ground in the Razorback State. Reform bubbles up in the most surprising places, and these poll results suggest Arkansans may be more receptive than most people imagined.

Europe: British Public Opinion Headed in Wrong Direction on Drug Policy, Poll Finds

If a comprehensive poll released last weekend is accurate -- and there is no reason to think it isn't -- British public opinion on drug policy is headed in the wrong direction. The poll conducted by ICM Research for the Observer and the Guardian newspapers found that public attitudes toward drug use, drug users, and drug sellers had grown decidedly more hard-line in recent years.

According to the poll, the proportion of people who think drug laws are "too liberal" has increased from 25% in 2002 to 32% now. At the same time, the number of people who think the drug laws are "not liberal enough" has dropped from 30% to 18%, and support for decriminalizing soft drugs has declined from 38% to 27%.

Respondents showed little sympathy for people who distribute drugs, whether they be professional drug dealers or merely sharing them with friends. About 70% said that all dealers should be treated the same -- with prison sentences. And 63% said drug addicts should be imprisoned.

Somewhat paradoxically, there is strong, though not majority, support for decriminalizing drug possession (38%) and making drugs available to addicts by prescription (44%).

Home Secretary Jacqui Smith told the newspapers hardening public attitudes were driven in part by concerns about stronger strains of cannabis. Both the Labor government and the British tabloid media have been engaged in a sometimes hysterical campaign to whip up fears about "skunk" in particular, as if that specific high-potency strain were somehow different from "regular" marijuana.

"This is a very important determinant of our decision to reclassify [cannabis from a Class C to a Class B drug]. This is a different drug even to that which was reclassified from B down to C [in 2003]," she claimed. "People are now beginning to recognize this isn't just some kind of harmless thing, but can have a serious impact on young people's mental health." People also realized marijuana production involved organized crime, she added.

But Martin Smith, the director of Drugscope, told newspapers the media and the government had falsely portrayed the drug problem as worse than it really was. "Although overall illegal drug use has been falling and significant progress has been made in tackling drug-related crime, many people believe the problem at best is getting no better," he said.

Feature: Signature Gathering for 2010 Oregon Cannabis Tax Act Initiative Suspended, Poor Poll Results Cited

An initiative that would have provided for the nation's first legal, regulated sale of marijuana for personal use is on hold. The organizers of the Oregon Cannabis Tax Act (OCTA) announced last weekend that they were suspending signature gathering for the proposed 2010 initiative after it did poorly in initial polling.

But while the OCTA is down, it may not be out. Organizers are suggesting they may be back with a rewrite in time to still make the 2010 ballot.

"We have suspended the OCTA campaign after completing our polling," Oregon NORML head Madeline Martinez confirmed to the Chronicle. "Although the numbers were not too bad, not far from a win."

Martinez and Oregon NORML had joined forces with D. Paul Stanford's The Hemp and Cannabis Foundation (THC Foundation) and its political action committee, the Committee for the Restoration and Regulation of Hemp (CRRH) to promote the initiative. Stanford was traveling and unavailable for comment this week.

The OCTA would have been groundbreaking. It provides for the state liquor commission (to be renamed the Oregon Cannabis and Liquor Control Commission) to license the cultivation of marijuana for sale in state liquor stores and its purchase by adults. It authorizes hemp growing, which would be outside the purview of the commission. It allows for the non-commercial personal growing of marijuana. It provides for the sale at cost to pharmacies and medical research facilities of marijuana for medicinal purposes.

But OCTA as written wasn't selling itself to potential voters, said Dr. Rick Bayer, chief petitioner for the 1998 OMMA. The initial polling results proved as much, he said. Neither the ballot title nor the summary of the initiative won majorities.

The ballot title and summary, written by the state attorney general, are as follows:

Ballot Title: Permits State-Licensed Cultivation of Marijuana, Sale of Marijuana to Adults Through State Liquor Stores

Results Of "Yes" Vote: "Yes" vote permits state-licensed cultivation of marijuana and sale to adults through state liquor stores; ninety percent of net proceeds to state general fund.

Results Of "No" Vote: "No" vote retains all existing prohibitions against the cultivation, manufacture, possession, and delivery of marijuana; retains current statues that permit regulated use of marijuana.

Summary: Current law prohibits cultivation, manufacture, possession, and delivery of marijuana, but permits regulated medical use of marijuana. Proposed measure replaces state, local marijuana laws exept driving under the influence laws. Directs renamed Oregon Cannabis and Liquor Control Commission to license marijuana cultivation by qualified persons and to purchase entire crop. Commission sells marijuana at cost to pharmacies and medical research facilities for medical purposes, and to qualified adults for profit through state liquor stores. Ninety percent of net proceeds goes to state general fund; smaller percentages for education, drug abuse treatment, promotion of hemp products. Bans sales to, and possession by, minors. Bans public consumption except where signs permit and minors barred. Commission to regulate illicit use, set price, other duties. Provides penalties. Other provisions.

"The OCTA ballot title, saying nothing about hemp, was politically unattractive," said Bayer, who had access to detailed polling results. "The ballot title alone polled 30%. Reading the summary, a far better -- but longer -- description of the OCTA, raised supporters to 39%. Telling people about the hemp part and re-polling the ballot title raised supporters to 42%."

That's not good enough, said Bayer. "Tax & Regulate polling at 42% if it had a good ballot title is the best I can make it. Even though 42% is good compared to the national average for tax & regulate, it won't win. These stats had a 95% confidence level or +/- 5%, so the results seem pretty reliable. Even to the most statistically challenged, it was clear that OCTA was not going to win."

But that doesn't mean OCTA is going away, said Martinez. "We know we can easily improve the language and poll very well during this economic crisis and refile in plenty of time for 2010," she reported. "We are very busy now rewriting, re-polling and refiling."

Of course, OCTA isn't the only game in town when it comes to Oregon and marijuana. Recent legislative sessions have featured battles over efforts to gut the OMMA, with more set to come next year. And at least one other group is looking at a medical marijuana initiative for 2010.

"I think it is a reasonable decision after they got polling results that showed it would be a difficult political environment to pass in 2010," said Anthony Johnson, political director for Voter Power, the group that directed the successful OMMA initiative campaign a decade ago and which is now gathering signatures to put a dispensary initiative, Initiative 28, on the 2010 ballot. "This may possibly free up resources and energy to help us get I-28 on the ballot for 2010."

Voter Power is currently trying to get the money together to do similar polling on its initiative, especially in the face of criticism that it could somehow threaten the OMMA. But that hasn't happened yet.

Both OCTA and Voter Power's dispensary initiative have their supporters and detractors in the state's fractious marijuana movement. In addition to tensions between medical marijuana activists and patients and full-out legalizers, the medical marijuana community itself is rife with factionalism and sniping. But it isn't just the marijuana community or the medical marijuana community that needs to be sold on either OCTA or the dispensary initiative -- it's the Oregon electorate.

Mark Souder vs. The New Drug War Politics

Mark Souder (R-IN) is running for re-election in a tight race, yet his campaign site doesn’t say one word about his extensive contributions as the leading congressional advocate for "tough on drugs" policies. It’s easily the defining issue of his political career, yet with everything on the line, he doesn’t seem to think his drug war demagoguery is a selling point for his campaign.

Public Opinion: Three-Quarters of Likely Voters Believe Drug War is Failing and More than One-Quarter Favor Legalization, Zogby Poll Finds

According to a Zogby/Inter-American Dialogue poll released Thursday, more than three-quarters of likely voters polled said America's drug war is a failure. That is a sharp contrast with current US and state drug policies. The poll also found significant differences between US policy in the hemisphere and what respondents would like to see.

On drug policy, 76% believe the US war on drugs is failing. That included the vast majority of Democrats (86%) and independents (81%) and even a majority of Republicans (61%). Among Barack Obama supporters, 89% agreed, and among John McCain supporters 61% agreed. While it is not clear that a belief that the war on drugs is failing suggests support for drug reform -- it could include those who believe it is failing because we have not tried hard enough -- it does suggest an emerging consensus that the current path is the wrong one.

When asked what was the best way to confront drug use and the international drug trade, respondents were split. Some 27% of likely voters said legalizing some drugs was the best approach (Obama supporters 34%, McCain supporters 20%); 25% said stopping drugs at the border (Obama supporters 12%, McCain supporters 39%); 19% said reducing demand through treatment and education; and 13% said crop eradication in source countries was the best approach.

The poll was by no means limited to drug policy. On other hemispheric issues, it found that 60% believe the US should revise its policies toward Cuba, 67% support a path to citizenship for tax-paying undocumented immigrants who learn English, 46% believe the US should seek to improve ties with Venezuelan President Hugo Chavez (10% want to completely break relations), 54% believe the US should lower tariffs on Brazilian ethanol, and 42% believe the North American Free Trade Agreement should be revised.

"The poll results indicate that American public opinion is far more open and flexible on issues of importance for US relations with Latin America than current policy would suggest," noted Peter Hakim, the President of the Inter-American Dialogue, a Washington think tank that collaborated with Zogby International on the poll. "It also suggests, however, that public opinion may not be all that relevant in decisions regarding policy issues of greatest concern to Latin America -- that these may be largely determined by smaller groups with intense sentiments about the issues," he said in a press release accompanying the poll results.

"While there are significant differences between Obama and McCain supporters on most issues, the poll suggests that the general public agrees on ethanol tariffs, temporary workers, and the failure of the drug war -- these are important issues in hemispheric relations that the next US president will have an opportunity to deal with," Hakim added.

Calvina Fay vs. The New Drug War Politics

The Drug Free America Foundation’s perpetually panic-stricken director Calvina Fay gave a speech at the World Forum Against Drugs that was so over-the-top crazy, I wish more people could have heard it.
